Electronic Disclosure & Litigation Support

e-discovery.jpgIn today’s fast paced global business environment, disputes will inevitably happen. Those that can’t be resolved easily may involve litigation and this, more often than not, requires some form of disclosure.

Electronic disclosure (often referred to as e-discovery)  involves the production of documents stored in electronic format. Under CPR part 31, in civil cases, or Police Criminal Evidence Act (1984) in criminal cases, these documents along with their metadata must be disclosed.

Even the simplest dispute may result in each party having to provide thousands of e-mails and user generated documents. In a complex dispute, where transactions have crossed international boundaries, the e-disclosure process can be a huge undertaking. Using CY4OR’s expertise in e-disclosure will accelerate the process saving time and money.

CY4OR offers a full service solution including  the collection, processing, review and production of electronically stored information (ESI).  Our comprehensive e-disclosure solution enables you to quickly review and organise information in our review suite or yours.

Key Steps

Preservation & Data Collection

The preservation of digital data is critical in many types of investigation. Imaging of computers and associated media should be considered in all cases where further investigation or disclosure may be required. Capturing this data using forensically sound methodology is vital if the integrity of any subsequent investigation is to be maintained.

Processing

The original data collection is reduced through applying various filtering and de-duping techniques, and native file review.  The integrity that was preserved in the collection stage is maintained ensuring that the legal team has confidence in the quality and significance of the data.

Review & Analysis

The reduced data set is loaded into a review environment suited to customer requirements.  The type of platform that we recommend will depend on whether a full document review or early case assessment (suitable for a first pass review) is required.  Online review is available should an organisation wish to extend their capabilities beyond the immediate legal team and interact with clients, counsel, expert witnesses and other parties.  An online review tool will also support cases across different jurisdictions and with multiple languages.

Production

Once data has been reviewed and the relevant evidence identified, it may be necessary to disclose these to another party or to produce them to counsel, court, experts or a regulator or government body.  We can provide disclosure suites which are independent secure review environments where defence parties can examine the prosecution's disclosure materials online.
